COUNTY OF NEWBERRY )

        

        AN ORDINANCE TO APPROVE GRANTING A 20 FOOT POWER LINE EASEMENT TO THE NEWBERRY ELECTRIC COOPERATIVE, INC. ACROSS THE AIRPORT PROPERTY ADJACENT TO THE PUBLIC ROAD LEADING FROM AIRPORT ROAD TO THE COUNTRY CLUB.

 

            WHEREAS, Newberry County owns the Newberry County Airport property, and is in the process of improving and lengthening the runway; and 

 

WHEREAS, the elevated power lines running parallel to Country Club Road from Airport Road toward the Newberry Country Club pose a potential hazard to general aviation operating at the Newberry County Airport, and the Newberry Electric Cooperative, Inc. has agreed to install the power line underground, if sufficient funding can be made available for that purpose, as well as the granting by the County to the Coop of a sufficient right of way for the installation, operation and maintenance of this underground power line; and

       

             WHEREAS, the Federal Aviation Administration and the S. C. Aeronautics Division have approved the funding of this addition of the Airport Improvement and Paving Project, in the same proportions as the rest of the project, and Newberry County Council has determined that the granting of this easement is a proper and necessary public purpose, which will not interfere with the uses of its property, but which will improve the safety of the operation of the Airport.

    

 NOW, THEREFORE,

        

             BE IT ORDAINED BY NEWBERRY COUNTY COUNCIL:

        

1. That the grant of the power line easement, in the form attached hereto as Exhibit “A,” requested by the Newberry Electric Cooperative, Inc. is hereby approved, and the Chairman of Newberry County Council is hereby authorized to execute same upon final approval of this Ordinance.

2.  The additional cost of installing this power line underground is approved as part of the Airport Improvement and Paving Project and the County’s portion of the required funding will come from the contingency account. A summary of the estimated total costs is attached hereto as an exhibit.

 

AND IT IS SO ORDAINED by Newberry County Council this ___ day of May, 2008 in meeting duly assembled at Newberry, South Carolina.
