AN ORDINANCE AMENDING
CHAPTER 154 OF THE NEWBERRY COUNTY CODE OF ORDINANCES, COMMONLY KNOWN AS THE
NEWBERRY COUNTY SUBDIVISION REGULATIONS, SO AS TO SIMPLIFY THE METHOD OF APPROVING
SURETY BONDS SUBMITTED IN LIEU OF COMPLETION OF SUBDIVISION IMPROVEMENTS,
INCLUDING AMENDMENTS TO SECTIONS 154.024(b)(4), 154.063(a) AND (e) AND THE
ADDITION OF SECTION 154.063(I), AND
OTHER MATTERS RELATED THERETO.
WHEREAS, Newberry County
Council, as the governing body of Newberry County, has the statutory authority
to adopt Ordinances governing the subdivision
of property, and with the input of the Newberry County Joint Planning
Commission, to make amendments to the text of the Subdivision Regulations,
found in Chapter 154 of the Newberry County Code of Ordinances, which will
apply in the unincorporated areas of the County, and inside those
municipalities in the County which have entered into an Agreement with the
County to allow the County’s Subdivision Regulations to regulate issues
relating to subdivision of property within that municipality; and
WHEREAS, Newberry County
Council, as authorized by Section
4-9-30 of the S.C. Code of Laws, 1976, as amended, and by Section 6-29-340, has received and
considered a recommendation from the Newberry County Joint Planning Commission
relating to the approval of the time for completion of subdivision improvements
by the Planning Commission and relating to simplifying the method by which
surety bonds, submitted in lieu of completion of roads and other subdivision
improvements, could be submitted, considered and approved or disapproved. The
recommendations are in the form of a report dated February 19, 2008, a copy of
which is attached; and
WHEREAS, AFTER DUE CONSIDERATION, IT IS ORDAINED THAT:

19, 2008 from the Newberry County Joint Planning Commission is ACCEPTED
in full, and adopted as fully as if set forth herein verbatim.
________2. The report and recommendation dated
February 19, 2008 from the Newberry County Joint Planning Commission is REJECTED.
________3. The
report and recommendation dated February 19, 2008 from the Newberry County
Joint Planning Commission is ACCEPTED AS MODIFIED hereafter, in full,
and with such modifications is adopted as fully as if set forth herein
