MINUTES
AUGUST 23, 2006
The Newberry County Council met on Wednesday, August 23, 2006, at 6:00 p.m. in the County Administrator’s Office at the Courthouse Annex, 1309 College Street, Newberry, SC, for a special called meeting.
Present were: Mike Hawkins, Chairman
William D. Waldrop, Vice-Chairman
John E. Caldwell, Councilman
Henry B. Summer, Councilman
John David Dawkins, Councilman
Andy Morris, Councilman
J.E. Klugh, Acting County Administrator
Absent: Edgar Baker, Councilman
Gary T. Pope, County Attorney

Notice of the meeting was duly advertised as required by law.
Mr. Hawkins called the meeting to order and determined a quorum to be present. Councilman Edgar Baker was not present due to a conflict of interest.
A personnel matter concerning the County Administrator was added to Executive Session. There being no further amendments to the agenda, the agenda was adopted as amended.
Mr. Morris moved to go into Executive Session for the purpose of a legal update on the Sheriff’s Office building on Highway 219; second by Mr. Summer. Vote was unanimous. [Councilman Baker absent]
At 7:35 p.m. Mr. Morris moved to return to open session; second by Mr. Waldrop. Vote was unanimous. [Councilman Baker absent]
Mr. Dawkins moved to authorize our attorney to file a lawsuit against Edgar Baker and W.E. Baker and Sons, Inc. on the Sheriff’s Building if Baker does not agree, by August 30, to correct all identified defects and begin correction of all defects per an agreed schedule; second by Mr. Morris. Vote was unanimous. [Councilman Baker absent]
[Councilman John Caldwell left the meeting after the above vote was taken.]
Mr. Morris moved to return to Executive Session to discuss a personnel matter concerning the County Administrator; second by Mr. Waldrop. Vote was unanimous. [Councilmen Baker and Caldwell absent]
Mr. Morris moved to return to open session; second by Mr. Waldrop. Vote was unanimous. [Councilmen Baker and Caldwell absent]
There was no report from the Executive Session.
There being no further business to come before Council, Mr. Dawkins moved to adjourn; second by Mr. Waldrop. Vote was unanimous.
Meeting adjourned at 8:20 p.m.
