MINUTES – WORK
SESSION
SEPTEMBER 27, 2006
The Newberry County Council met on Wednesday, September 27, 2006, at 5:00 p.m. in Council Chambers at the Newberry County Courthouse, 1309 College Street, Newberry, SC for a work session.
Present were: Mike Hawkins, Chairman
William D. Waldrop, Vice-Chairman
John E. Caldwell, Councilman (arrived 5:30 p.m.)
Henry B. Summer, Councilman
John David Dawkins, Councilman
Andy Morris, Councilman
Edgar Baker, Councilman
J.E. Klugh, Acting County Administrator
Wayne Adams, County Administrator-elect
Gary T. Pope, County Attorney

Notice of the meeting was duly advertised as required by law.
Mr. Hawkins called the meeting to order and determined a quorum to be present.
Mr. Morris moved to go into Executive Session for legal advice relating to financing options for capital projects; second by Mr. Baker.
Mr. Waldrop raised the issue of Council being ridiculed in The Newberry Observer so many times about going into Executive Session and asked what it pertained to.
Mr. Pope advised that Council would receive legal advice relating to various financing options, which are proper Executive Session matters, but if Council chooses not to go into Executive Session, that is your option. Mr. Pope’s opinion was that it was appropriate Executive Session material.
Mr. Adams requested that the Clerk to Council be allowed to remain in Executive Session. After discussion, it was the consensus of Council that she be allowed to remain. Others remaining in Executive Session were: Theo DuBose, Bond Counsel, and Chloe Jaco and Jack Grimes with Carter Goble Lee.
There being no further discussion as to the motion to go into Executive Session, Mr. Hawkins called for the vote. Voting for the motion: Councilmen Hawkins, Waldrop, Summer, Dawkins, Morris and Baker. Councilman Caldwell was absent. Motion passed.

Mr. Morris moved to return to open session; second by Mr. Dawkins. Vote was unanimous.
Mr. Hawkins advised that Council received legal advice about financing options. Council made sure that the building on Highway 219 formerly occupied by the Sheriff’s Office was not discussed. Had Council gotten to that point Mr. Pope and Councilman Baker would have been asked to leave.
Mr. Morris moved to adjourn; second by Mr. Baker. Vote was unanimous.
Meeting adjourned at 6:26 P.M.
