NEWBERRY COUNTY COUNCIL

MINUTES

DECEMBER 27, 2006

 

 

Newberry County Council met on Wednesday, December 27, 2006, at 7:00 p.m. in Council Chambers at the Courthouse Annex, 1309 College Street, Newberry, SC, for a special meeting.                

 

Present were:                Mike Hawkins, Chairman

                                    William D. Waldrop, Vice-Chairman

                                    John E. Caldwell, Councilman 

                                    Henry B. Summer, Councilman

                                    John David Dawkins, Councilman

                                    Andy Morris, Councilman

                                    Edgar Baker, Councilman

                                    Wayne Adams, County Administrator

                                    Gary T. Pope, County Attorney

                                    Susan C. Fellers, Clerk to Council

Notice of the meeting was duly advertised as required by law.

 

Mr. Hawkins called the meeting to order and determined a quorum to be present.   

 

Mr. Pope had the invocation followed by the Pledge of Allegiance.

 

3.            Additions, deletions and adoption of agenda.

 

Mr. Dawkins requested the addition of public comments as agenda item 4.1.

 

Mr. Morris advised that after agenda item 4 he would need to leave because of a personal emergency.

 

There being no further additions or deletions to the agenda, Mr. Dawkins moved to adopt the agenda as amended; second by Mr. Hawkins. 

 

Mr. Summer asked what limits would be put on public comments.  Mr. Hawkins advised that would be up to Council.  Mr. Summer felt the normal rule of three minutes should apply.

 

There being no further discussion, Mr. Hawkins called for the question.  Vote was unanimous. 

 

4.            Ordinance #12-49-06:  An Ordinance authorizing the transfer of all right, title and interest in, and all rights and obligations under, the Inducement Agreement and the Lease Agreement between Newberry County, as Lessor, and Trucast, Inc., as Lessee, authorizing among other matters, the payment of a fee in lieu of tax to Newberry County.

 

Mr. Hawkins called for the public hearing. 

 

Mr. Pope advised this was a reorganization of Trucast from a Delaware corporation to a Delaware LLC.  It does not affect the fee in lieu of taxes or the number of employees they have.  This is a technical matter. 

 

There being no comments from the public, Mr. Hawkins declared the public hearing closed.

4.1       Public Comments.

 

Mr. Hawkins explained that because the ordinance to rescind reassessment was not given second reading, there would be no third reading.  The only way it could be reversed would be for some member who voted on the prevailing side to make a motion to reconsider. 

 

The following persons were allowed to speak, all of whom spoke about matters relating to property taxes and reassessment:  Mike Bedenbaugh, Brian Blanchard, Reba Lester, Peter Olsen, Jim Smith, Kevin Palmer, Alan Gardner, Ralph Wicker, Doris Cubitt, Unidentified man in black jacket, Abigail Holland, Ronnie Hydrick, Susan Logan, Terry Cotney, Nancy Dickert, Victor Terrana, Unidentified man in plaid shirt, Tom Crooks, Al ???, Rhonda Moore, and Unidentified woman. 

 

5.         Future meetings.

 

Mr. Caldwell moved to hold the meeting at the Opera House; second by Mr. Baker.  Mr. Dawkins requested an amendment that it be held at the Opera House or the College or a bigger place.  Mr. Caldwell so amended his motion.  Voting for the motion:  Councilmen Hawkins, Caldwell, Dawkins and Baker.  Voting against the motion:  Councilmen Waldrop and Summer.  (Councilman Morris absent).  Motion passed by majority vote.

 

6.            Adjournment.

 

There being no further business, Mr. Waldrop moved to adjourn; second by Mr. Baker.  Vote was unanimous.  (Councilman Morris absent)
