) RESOLUTION NO. 22-07

COUNTY OF NEWBERRY )

WHEREAS, Newberry County Council, as the governing body of Newberry County, has appointed a Road Committee composed of County Council members, the function of which is to investigate issues relating to County roads and to make decisions concerning same, and where indicated, to make recommendations to Newberry County Council for further action; and

WHEREAS, the Road Committee received a request from the School District of Newberry County with regard to a new access road and right of way to the Pomaria Garmany School on property the School District proposes to acquire from an adjoining landowner. On this property, the School District will construct a new paved road to County specifications on a dedicated 66 foot right of way off of Highway 176 onto the School property. This new road and right of way will also serve the rear portion of the remaining property of the landowner, who is providing the property, consisting of two parcels, to the School District. As part of this process, the School District will ask the SC Department of Transportation to abandon the existing state road which provides access to the campus. After the sale of the two parcels to the School District, the adjacent landowner’s access to her remaining property could be severely restricted. For this reason, she has asked for assurances that she will be able to gain access to her remaining property by means of the proposed new road and right of way to be constructed by the School District; and

WHEREAS, the School District cannot move forward with the acquisition of these two parcels without a commitment from the County to accept the new road into the County system, if it is constructed to County specifications and the 66 foot wide right of way, as described above, is dedicated and conveyed for that purpose; and

WHEREAS, the County Council Road Committee has recommended favorable action on the request of the School District of Newberry County in this matter.

IT IS THEREFORE RESOLVED, THAT, after due consideration of the proposal from the School District of Newberry County, and the recommendation of the County Council Road Committee, Newberry County Council hereby resolves to accept the proposal from the School District and hereby takes formal action to commit to accept the road and right of way into the County system, if it is constructed to County specifications and a 66 foot right of way is dedicated for that purpose, and conveyed to the County

AND IT IS SO RESOLVED by Newberry County Council in meeting duly assembled this 17^th day of October, 2007.
