GENERAL
INFORMATION ON THE CLERK'S OFFICE
The
Clerk of Court is responsible for various administrative and
ministerial duties in conjunction with the Court of Common Pleas.
These duties include filing, docketing, indexing, and preserving all
court pleadings for civil, felony criminal and domestic relations
cases. The Clerk of Courts must also follow procedure required by law
and issues writs to carry out Court orders. Some of these writs
include summons, subpoenas, warrants to arrest and to convey to penal
institutions, and signing the death warrant in capital cases. The
Clerk is responsible for the receipt and disbursement of all money
paid into the court system.
Real
Estate Records
The
Clerk of Court is responsible for filing and maintaining all legal
documents that pertain to real and personal property in Newberry
County. These documents may consist of deeds, mortgages, contracts,
leases, powers of attorneys, plats of property, easements, and other
types of documents. They are usually the documents necessary to
transfer or prove ownership of property or identify the exact
location of a tract or lot of land. These records are available to
title examiners and the public for research from 8:30 am to 5:00 PM
Monday through Friday in room 5 of the Court House , located at 1226
College Street.
