Newberry County FOIA Request

Newberry County charges a fee for the cost of searching and/or making copies of records. When the requester has completed and submitted the FOIA Request Form, a written response will be mailed within 10 working days from the date the request was received. The requester will receive a response if the request is approved or denied. Provided that the request is approved, and the documents are available and not subject to exemption, a cost for the request will be included in the County’s response. Once the payment is received, the records will be made available to the requester.

Section 30-4-30(B) S.C. Code of Laws, 1976, as amended, provides as follows:

 

The public body may establish and collect fees not to exceed the actual cost of searching for and making copies of records. The custodian of the public records may charge a reasonable hourly rate for making records available to the public and may charge a deposit not to exceed twenty-five percent of the reasonably anticipated costs before searching for or making copies of the records.

 

Schedule of Newberry County Charges

 

Copies:                                    Fifteen cents ($0.15) for black and white and fifty cents ($0.50) for color per page. 

Research & Preparation:      Ten Dollars ($10.00) per hour for staff time below the department head level. 

Executive Staff:                      Based on actual compensation; for use only if unavoidable 

 

A deposit not exceeding twenty-five percent of the estimated cost of retrieving and copying requested information will be required for copies in excess of 100 pages, or if the request relates to information not readily retrievable or which will require unusual staff time to provide.

 

Salaries over $50,000

 

The Family Privacy Protection Act (South Carolina Code Annotated §30-2-50) prohibits any person or entity from knowingly obtaining or using any personal information obtained from the Count for commercial solicitation directed to any person in the state. Violation of this law is a crime.
