The Delinquent Tax Collector's office does have the option to submit delinquent debt to the South Carolina Department of Revenue (SCDOR) to set off against an individual's income tax refunds until the debt is paid in full, as authorized under the Setoff Debt Collection Act, Chapter 56 of Title 12 of the South Carolina Code (1976).

Mobile homes not part of the yearly Tax Sale, watercraft and motors, and Business Personal Property are subject to be setoff if not paid.

Should your debt be submitted, an additional $50 ($25 to SCDOR and $25 to SCAC) in administrative fees will be added to what is taken from your refund. If you file a joint return with your spouse, this amount will bededucted from the total joint refund without regard to which spouseincurred the debt or actually withheld the taxes.
